Ownership of Content
Filmopixel retains full, exclusive, and irrevocable ownership of all content it produces, creates, or otherwise acquires the rights to. This includes, but is not limited to, photographs, video recordings, sound recordings, film scripts, music compositions, software, animations, visual designs, creative concepts, artwork, logos, trademarks, and any other media or intellectual property created by or for Filmopixel. All rights to such content are held by Filmopixel or its designated contributors, licensors, or affiliated parties, unless otherwise specified in writing under a separate agreement.
The ownership of Filmopixel’s content extends to all tangible and intangible aspects of the works, including but not limited to:
- Copyright: All Filmopixel content is protected under copyright law, and Filmopixel holds exclusive copyright over the creative works it produces, including rights to reproduction, distribution, public performance, display, and derivative works.
- Trademarks: Any logos, branding elements, or specific visual representations associated with Filmopixel, its products, or services are trademarked. Unauthorized use of these trademarks constitutes trademark infringement.
- Patents and Trade Secrets: Any unique processes, technologies, or proprietary methods developed or used by Filmopixel that are protected by patents or trade secret laws remain the intellectual property of Filmopixel.

- Modification Restrictions: Users may not modify, alter, adapt, translate, reverse engineer, decompile, or otherwise attempt to create derivative works based on Filmopixel content without explicit written consent. - No Transfer or Sub-Licensing: Users are not permitted to transfer, sublicense, or assign the rights to use Filmopixel’s content to any third party without obtaining prior written consent from Filmopixel. License Grant
By entering into a licensing agreement with Filmopixel, the licensee is granted a non-exclusive, non-transferable, and revocable license to use the content as specified in the terms of the agreement. This license does not grant ownership of the content, nor does it provide the right to sublicense, redistribute, or transfer the content to any third parties unless explicitly stated otherwise in the agreement.
Specifically, the license grants the following rights and imposes the following obligations, unless otherwise stipulated in the licensing agreement:
- Permitted Use:
The licensee is granted the right to use the content for specific purposes as defined in the licensing agreement. Permitted uses may include, but are not limited to, personal, educational, commercial, and promotional purposes. All uses must comply with the limitations outlined in the agreement. The licensee must not exceed the scope of usage described in the agreement. For commercial use, additional fees may apply depending on the nature of the project and the distribution of the content. Commercial use includes, but is not limited to, content used in advertisements, films, television, online platforms, and other forms of media intended for commercial gain. For each specific use, the licensing agreement may require the licensee to provide detailed descriptions of how the content will be used.
- Prohibited Use:
The content is provided to the licensee for specific use under the terms outlined in the agreement. The licensee is expressly prohibited from using the content in any of the following ways:
- Illegal Activity: Any use of the content in activities that are unlawful, including but not limited to actions that violate any laws, statutes, regulations, or ordinances applicable in any jurisdiction.
- Defamatory or Harmful Content: The licensee may not use the content to create or promote defamatory, libelous, abusive, or harmful content that could damage the reputation of Filmopixel, its contributors, or any individuals depicted in the content.
- Hate Speech or Political Advocacy: The content may not be used in a manner that promotes hate speech, violence, discrimination, or political advocacy that could be harmful or offensive to others.
- Offensive Material: The content must not be used in any form that promotes pornography, explicit violence, or any other material deemed offensive or inappropriate in nature by Filmopixel or under local or international law.
Any violation of these prohibitions will constitute a breach of the licensing agreement and may result in the immediate revocation of the license, along with legal consequences, including but not limited to claims for damages.
- Modification of Content:
The licensee is not permitted to modify, edit, alter, transform, adapt, or create derivative works based on the content without prior written consent from Filmopixel. This prohibition includes altering visual or audio elements, changing the composition, adding or removing effects, or combining the content with other works that change its original nature.
For the avoidance of doubt, any alteration to the content in a way that affects the integrity, context, or meaning of the work is prohibited. Should the licensee wish to alter or modify the content, they must submit a request to Filmopixel for approval, and such modifications may be subject to additional licensing fees or conditions. Any modification without approval constitutes a violation of the agreement.
- Distribution and Sharing:
The licensee is not authorized to distribute, share, license, sell, sublicense, or otherwise transfer the content to third parties without prior written consent from Filmopixel. This includes distributing content through digital media (e.g., websites, social media platforms, cloud storage), physical media (e.g., DVDs, Blu-rays, printed materials), or any other form of content sharing.
If the content is to be shared publicly, such as on social media, websites, or video streaming platforms, the licensee must first obtain explicit permission from Filmopixel and comply with any terms or restrictions placed on such sharing. Publicly sharing content without written consent is considered a breach of this agreement.
Additionally, the licensee may not use the content in any context that may suggest or imply an endorsement by Filmopixel, or any other third party, unless such use is explicitly permitted by the licensing agreement.
- Geographic Limitations:
The use of content may be subject to specific geographic limitations as outlined in the licensing agreement. The licensee is prohibited from using the content in any country or jurisdiction where such use would be prohibited by law or where Filmopixel has not granted explicit permission to use the content.
- Duration of Use:
The rights granted by this license are valid for the duration specified in the licensing agreement. Once the term of the agreement expires or is terminated for any reason, the licensee must cease all use of the content, remove it from any platforms where it has been published or distributed, and destroy all copies of the content in their possession. Continued use of the content after the expiration or termination of the license is strictly prohibited.
- Attribution:
Unless otherwise stated in the licensing agreement, the licensee agrees to credit Filmopixel as the source of the content whenever the content is publicly displayed or used. This may include the requirement to include a watermark, logo, or other attribution on digital or physical formats. Failure to provide proper attribution constitutes a breach of the agreement.
By accepting this license, the licensee acknowledges and agrees to abide by all terms and conditions outlined in this section and the full licensing agreement. Violation of these terms will result in the revocation of the license and may lead to legal action, including claims for damages, as provided under the applicable laws.
Denied Permission to Use Without Consent
Any use of Filmopixel’s content, in any form, without prior written consent from Filmopixel is strictly prohibited. This includes, but is not limited to, reproduction, modification, adaptation, distribution, public display, public performance, digital transmission, or any other unauthorized use or exploitation of Filmopixel content. This restriction applies regardless of the medium or platform, whether it be physical (e.g., DVDs, posters) or digital (e.g., websites, social media platforms, video streaming services, apps, or any form of digital broadcast).
The prohibition extends to all forms of commercial or non-commercial usage, including but not limited to:
- Reproduction: Making copies of Filmopixel’s content in any format (e.g., physical prints, digital copies) for distribution or personal use.
- Modification: Altering, editing, or creating derivative works based on Filmopixel’s content, including cropping, color correction, or adding new elements.
- Distribution: Selling, lending, or distributing Filmopixel’s content, whether in digital or physical form, to third parties without proper authorization.
- Public Display or Performance: Showing or broadcasting Filmopixel’s content on TV, film screenings, public venues, or online platforms without explicit consent.

Filmopixel reserves the right to actively monitor the use of its content on various platforms, both online and offline, to ensure that no unauthorized or unlawful use takes place. Any individual, organization, or entity found to be using Filmopixel’s content without proper authorization will be considered to be in violation of the terms set forth in this agreement and will face immediate legal consequences.
Legal actions for unauthorized use include, but are not limited to:
- Injunctions: Filmopixel may file for injunctive relief, seeking an order from a court to prevent further unauthorized use or distribution of the content.
- Compensation for Damages: Filmopixel will seek financial compensation for lost revenue, including any profits generated by the unauthorized use, and any associated legal costs incurred as a result of the infringement.
- Statutory Penalties: Filmopixel will pursue statutory penalties under the Indian Copyright Act, 1957, which may include fines and imprisonment for repeat offenders.
- Loss of Licensing Rights: Any existing licenses granted to the infringing party may be immediately revoked, and future licensing agreements may be denied.
- Public Legal Actions: Filmopixel may take public legal action to seek damages for the infringement, which may damage the infringing party’s reputation.
In the event of any unauthorized use of Filmopixel content, Filmopixel is entitled to pursue full legal remedies, including civil litigation, criminal prosecution, and statutory damages.
